2. Personal data collected
Through the contact form available on this website, users voluntarily provide the following personal data:
- Full name
- Email address
- Phone number
No special categories of personal data are collected within the meaning of Article 9 GDPR (health data, racial or ethnic origin, political opinions, etc.).
Additionally, with the user's consent, anonymised browsing data may be collected via Google Analytics (see our Cookie Policy).
3. Purposes of processing
The personal data provided through the contact form are processed for the following purposes:
- Handling and managing requests for information or demonstrations of the SnapHouse software.
- Responding to queries submitted by the user through available channels.
- Communicating with the client regarding the use, operation and any issues related to the SnapHouse tool.
- Informing the user about updates, new features and improvements to the SnapHouse software.
- Informing about other Hipnosia services related to real estate marketing, such as SnapHouse 360 Tours, a platform for creating and hosting interactive virtual property tours.
- Sending commercial information about SnapHouse and other Hipnosia products or services, where the user has given explicit consent.
Data will not be used for any purpose incompatible with those described above.
4. Legal basis for processing
The processing of personal data is based on the following legal grounds under Article 6 GDPR:
- Explicit consent of the data subject (Article 6.1.a GDPR): the user explicitly accepts this privacy policy by ticking the checkbox provided in the contact form, in accordance with Article 7 GDPR and Article 6 LOPDGDD.
- Legitimate interest of the controller (Article 6.1.f GDPR): management and response to product information requests.
Consent given may be withdrawn at any time without affecting the lawfulness of processing carried out prior to withdrawal.
5. Recipients and data processors
Personal data collected through the contact form is automatically transmitted via Make.com (Celonis SE, based in the USA), used as an automation tool for managing requests and sending communications.
Make.com acts as a data processor within the meaning of Article 28 GDPR. The relationship is governed by the standard contractual clauses approved by the European Commission and the EU-U.S. Data Privacy Framework (DPF), which provides adequate protection for international transfers pursuant to Article 46 GDPR.
Personal data will not be shared with third parties except where required by law or strictly necessary for service delivery.
6. International data transfers
As noted above, the use of Make.com may involve transfers of data outside the European Economic Area. Such transfers are covered by the EU-U.S. Data Privacy Framework (DPF), adopted by the European Commission on 10 July 2023, pursuant to Article 45 GDPR.
The use of Google Analytics may also involve transfers to Google LLC (USA), equally covered by the DPF. For more information, see our Cookie Policy.
7. Retention period
Personal data will be retained for as long as necessary to fulfil the user's request and, where applicable, for the period required to comply with legal obligations arising from the established relationship.
Once the purpose for which they were collected has been fulfilled, data will be deleted or anonymised, unless there is a legal obligation to retain them for a specific period.
8. Rights of data subjects
Data subjects may exercise the following rights at any time, free of charge, by contacting the data controller at info@snaphouse.dev:
- Access: find out what personal data is being processed and obtain a copy.
- Rectification: request correction of inaccurate or incomplete data.
- Erasure ("right to be forgotten"): request deletion of data when, among other reasons, it is no longer necessary for the purpose for which it was collected.
- Restriction of processing: request suspension of processing in the cases set out in Article 18 GDPR.
- Data portability: receive data in a structured, commonly used, machine-readable format and transmit it to another controller where technically feasible.
- Objection: object to processing based on the controller's legitimate interest.
- Withdrawal of consent: without affecting the lawfulness of prior processing.
- Not to be subject to automated decisions: pursuant to Article 22 GDPR.
To exercise these rights, users must send a written request to info@snaphouse.dev, stating the right they wish to exercise and enclosing a copy of a document proving their identity.
The controller will respond to the request within a maximum of one month of receipt, extendable by a further two months in cases of particular complexity (Article 12 GDPR).
Users also have the right to lodge a complaint with the competent supervisory authority in Spain: the Agencia Española de Protección de Datos (AEPD), C/ Jorge Juan, 6, 28001 Madrid — www.aepd.es.
9. Security measures
The data controller has implemented the necessary technical and organisational measures to ensure the security and integrity of personal data and to prevent its alteration, loss, unauthorised processing or access, taking into account the state of technology, the nature of the data stored, and the risks to which they are exposed, pursuant to Article 32 GDPR.
10. Minors
This website is not intended for users under the age of 14. Pursuant to Article 7 LOPDGDD, the processing of data of persons under 14 years of age requires the consent of their parents or legal guardians. The controller does not knowingly collect data from minors. If such a circumstance is detected, the data will be immediately deleted.
11. Updates to this policy
This policy may be modified to adapt to regulatory, case-law, or service changes. We recommend checking this page periodically. The date shown in the header reflects the current version. In the event of substantial changes, users will be informed through available channels.
